SMSF Trust Deed

By obtaining a Trust Deed for your Self Managed Super Fund, this evidences the establishment of the Trust and sets up the rules for operation of the Fund.

It is important that your Trust Deed is drafted to enable the use of the wide array of strategies that can be implemented within self managed superannuation funds today, in particular with the introduction of the Simplification of Superannuation (Simpler Super) reforms on 1 July 2007.

In considering a trust deed, it is important to ensure that the fund’s governing rules incorporate the ability to:

  • Admit a broad range of members into the fund - the fund should not limit membership to employees or those who are gainfully employed.
  • Allow replacement or stand-in trustees, in the event of death, legal disability or if a member is a minor.
  • Providing flexibility in voting power and control of the fund, including ability to cast votes based on the account balance of each member.
  • Accept any contribution to the fund that is allowable under superannuation law, including amounts from government agencies (i.e. co-contribution amounts).
  • Accept in-specie contributions, and to pay in-specie benefit payments for and on behalf of its members.
  • Ability to pay any type of pension that is allowable under superannuation law (including transition to retirement income streams).
  • Pay death benefits as either a lump sum or pension, or a combination of the two.
  • Establish and maintain reserves in accordance with superannuation law.
  • Provide asset valuation methods and allocation of income methods.

It is important that the deed is dated and properly executed once established.
